Guy who attacked Uber driver is now suing him for $5m
Remember the guy who attacked the Uber driver? We posted about it a few months back when the video went viral. Not only did the perpetrator go to jail on four misdemeanour charges, but he also got fired from his job as a Taco Bell executive.
Well now, this same guy, who by all accounts doesn’t seem like the nicest guy, is suing the Uber driver for $5 million on the grounds that the man illegally recorded the incident. I mean, come on! Seriously?
This said punk guy, Benjamin Golden, wants this absurd amount of money for an Uber driver who I can only assume does not have that kind of money lying around. But wait, it gets better! Golden also stated in the court papers that the driver, Edward Caban, is at fault for injuries he sustained. Can you believe what you are reading? I certainly cannot!
So the basis of Golden’s argument is that in California, where the incident took place on October 30th last year, a state statute requires consent of all parties for recordings to be made. Thankfully, Caban also has a lawyer and he seems to know what he is doing, this is reported by CNBC,
“Morrell [Caban’s lawyer] also said that Caban had told Golden he was recording their ride. The lawyer also said that he believes that the state penal code only applies to audio recording, not video recording.
“He lost his job because of the video” portion of the record, which showed the violence, Morrell said. The lawyer said the audio portion did not play a role in Golden getting fired.”
Golden also says in his filings that because of the “overwhelming media coverage” of the video, he has “suffered severe emotional distress, humiliation, anxiety, fear, pain and suffering and the loss of his job.” Most of this sounds like what he inflicted on Caban, but ok!
Shortly after the incident, Golden apologised to Caban and he said that upon seeing the video his heart sank and repeatedly stated that the video doesn’t show the person he truly is. He also claimed he could not remember the incident.
So what exactly changed? He lost his job and realised behaving in such a manner is just not acceptable and has certain consequences? So now he needs to sue the guy?
We hope this gets thrown out of court!
